Selfies, self-taken photographs, and videos are protected from unauthorized distribution under most states revenge porn laws and under federal copyright laws. Likewise, laws dealing with harassment, extortion, or invasion of privacy may also provide protection for selfies depending on your state. In Utah, selfies are protected from unauthorized distribution.

How to Stop Revenge Pornography

Take these steps to stop revenge pornography:

  1. Download and save everything

    To take down revenge porn the first step is to figure out where it is located and preserve the evidence. Download all of the images along with screenshots of the websites where they are located. Be sure the screenshots include the user name of the person who uploaded the images.

    If you know the perpetrator, it is also crucial to save all text messages between the two of you. Text messages may contain the images but they also often depict the anger, resentment, or other animosity coming from the perpetrator. Let their own words help prove your case. Save all the text messages.

  2. Contact an experienced litigation attorney

    Before doing anything else you should contact an attorney with experience in these matters. There are negative consequences to proceeding without legal counsel. Ignoring the right ways to proceed can cost you your case and let the perpetrator get away with his crime.

  3. File a police report

    In many cases you will want to file a police report. This helps document the revenge porn and may result in the criminal prosecution of the perpetrator. Only file a police report if your attorney recommends doing so. There are reasons why you may not want to file a criminal report or to delay filing one.

  4. Remove the sexually explicit content

    A crucial part of helping you stop the harmful effects of the unauthorized distribution of your private intimate images and videos is taking it all down from the Internet. It is generally impossible to completely scrub the entire Internet of this content but most of it can be taken down and blocked. Removing the content takes a lot of time and effort but is worth it in most cases. Using your state’s revenge porn laws and sometimes even invoking federal copyright laws can be a good way to remove the materials.

  5. Sue the perpetrator and website operators

    All of the other steps lead to this final step of filing the proper lawsuits. You can hold the perpetrator and any website operators responsible financially for the harm the illegal pornography posting caused. Under federal law you could get up to $150,000.00 or more in damages. The lawsuit also helps take down the images and allows for a permanent injunction to prevent the perpetrator from distributing any other images or videos.
